These Terms of Use (“Terms,” “Agreement”) constitute a legally binding agreement between you and Polish Pages, Inc., a New York Corporation (“Company,” “Polish Pages,” “we,” “us,” or “our”), governing your access to and use of the classifieds platform located at https://drobnica.com (“Drobnica,” the “Site,” or the “Service”).

Please read these Terms carefully. By accessing the Site, posting a listing, responding to a listing, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you post a listing, you will be asked to affirmatively accept these Terms by checking a box. These Terms contain a binding arbitration provision and class action waiver (Section 17) that affect your legal rights. If you do not agree, do not use the Service.

1. Definitions

“Content” — any information, text, listing, classified advertisement, image, photograph, video, graphic, contact detail, price, description, message, or other material submitted to, generated on, or made accessible through the Service.
“Listing” (ogłoszenie) — any classified advertisement posted on the Service, including job postings, real estate, vehicles, services, household goods, and lawful community notices and other permitted classifieds, excluding dating, escort, adult, sexual, or exploitative services.
“User,” “you,” or “your” — any person who accesses or uses the Service, whether as a registered account holder, guest poster, buyer, seller, or visitor.
“Poster” — a User who submits a Listing, whether or not they have a registered account.
“Registered User” — a User who has created an account.
“Featured/Promoted Listing” — a paid placement that increases the visibility or duration of a Listing.

2. Eligibility

You must be at least 18 years old to post a Listing, respond to a Listing, create an account, or purchase any paid feature. By using the Service, you represent and warrant that you are at least 18, that the information you provide is true, accurate, and current, and that your use will not violate any applicable law. We may refuse service, remove Listings, suspend or close accounts, or change eligibility requirements at any time, at our sole discretion.

3. Nature of the Service — Important Disclaimer

Drobnica is a venue and a platform, not a party to transactions between Users.

We provide an online classifieds platform that allows Users to post and view Listings. We are not a broker, agent, auctioneer, employment agency, or real estate broker, and we are not a party to any transaction between Users. We do not own, sell, resell, furnish, deliver, manage, or control any item or service advertised.

You acknowledge and agree that:

We do not verify Listings, Users, or their identity. We do not guarantee the truth, accuracy, legality, quality, safety, or availability of any Listing, item, or service.
Transactions are solely between Users. Any agreement, payment, exchange, employment, lease, or sale arising from a Listing is strictly between the Users involved. We are not responsible for and disclaim all liability arising from such transactions.
You deal with other Users at your own risk. You are solely responsible for reasonable precautions — meeting in safe public locations, verifying identity and authenticity, and not sending money or financial information to people you do not trust.

We strongly encourage caution. Never wire money, send gift cards, or share financial account details with someone you have not verified. Be especially cautious of deals that seem too good to be true, requests for advance payment, and offers from outside your local area.

4. User Accounts (Optional)

Creating an account is optional — you may post a Listing as a guest. If you create an account: you are responsible for the confidentiality of your credentials and all activity under your account; you agree to notify us of any unauthorized use; you may not share, sell, or transfer your account; and we are not liable for loss from unauthorized use. Whether you post as a guest or a Registered User, you are equally bound by these Terms.

5. Listings and User Content

5.1 Your Responsibility for Content

You are solely responsible for any Content you submit, including every Listing. You represent and warrant that, for each piece of Content: you own it or have all necessary rights; it is accurate and not misleading; it does not infringe any third party’s intellectual property, privacy, publicity, or other rights; it does not violate any applicable law or these Terms; and the item or service offered is one you have the legal right to sell, lease, offer, or advertise.

5.2 License You Grant to Us

When you submit Content, you grant Polish Pages a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, use, reproduce, modify (for technical purposes such as formatting and resizing), publish, publicly display, publicly perform, and distribute that Content, solely for the purposes of operating, providing, promoting, and improving the Service. This license continues for as long as your Content remains on the Service and for a reasonable period thereafter for backup and legal-compliance purposes. You retain ownership of all IP rights in your Content.

5.3 No Obligation to Publish or Retain

We reserve the right, but assume no obligation, to review, screen, refuse, edit, reject, remove, or relocate any Listing or Content at our sole discretion, before or after publication, without notice and without liability. We have no obligation to retain or store your Content and may delete expired, withdrawn, or removed Listings at any time.

5.4 Listing Duration and Expiration

Listings remain published for the period indicated at posting or until removed by the Poster, by us, or upon expiration. We may remove or archive expired Listings without notice.

6. Prohibited Listings and Conduct

You agree not to post any Listing or Content, or use the Service, in connection with:

Prohibited items and services:

Illegal goods, services, or activity of any kind;
Weapons, firearms, ammunition, explosives, or regulated weapon accessories;
Illegal drugs, controlled substances, drug paraphernalia, or prescription medications;
Tobacco, vaping, or e-cigarette products;
Counterfeit, stolen, or recalled goods;
Adult content, sexual services, escort services, dating/companionship-for-hire, or content that sexually exploits any person;
Human trafficking, or exploitation of minors in any form;
Live animals where prohibited by law, or any sale violating animal-welfare laws;
Hazardous materials or items prohibited by law;
Financial schemes, pyramid schemes, MLM recruitment, cryptocurrency investment offers, payday lending, or “get rich quick” offers;
Lottery, raffles, or gambling services where prohibited;
Personal or confidential information of third parties;
Any offer requiring advance fees or wire transfers as a condition of a job or opportunity.

Prohibited conduct:

Posting false, fraudulent, deceptive, misleading, defamatory, obscene, harassing, threatening, hateful, or discriminatory Content;
Discriminatory job, housing, or other Listings that violate fair-employment, fair-housing, or anti-discrimination laws (including the federal Fair Housing Act and applicable New York State and City Human Rights Laws);
Creating fake accounts, fake Listings, fake buyer/seller identities, fake testimonials, fake reviews, fake availability, fake pricing, fake licensing claims, or fake business affiliations;
Submitting fake reviews, misleading endorsements, undisclosed paid testimonials, or fabricated business claims;
Impersonating any person or entity, or misrepresenting your affiliation;
Posting spam, duplicate Listings, or off-topic commercial solicitation;
Harvesting, scraping, or collecting other Users’ information; using bots or automated tools;
Interfering with, disrupting, or gaining unauthorized access to the Service;
Posting any virus, malware, or harmful code;
Using the Service in any way that violates U.S. federal, state, or local law.

We may remove such Content and preserve related records for fraud prevention, legal compliance, and cooperation with law enforcement.

6.1 Regulated-Industry Listings

Posters advertising in regulated fields — legal, medical, financial, immigration, and real-estate services — must comply with all applicable professional and advertising regulations. We do not verify such compliance; the Poster bears sole responsibility.

6.2 Housing Listings

Housing Posters are solely responsible for complying with applicable fair-housing, rent-regulation, source-of-income, disability-accommodation, broker, licensing, deposit, occupancy, and anti-discrimination requirements, including the federal Fair Housing Act and applicable New York State and City Human Rights Laws. We do not review housing Listings for such compliance.

6.3 Job Listings

Job Posters are solely responsible for complying with applicable employment, wage, pay-transparency, licensing, immigration, equal-employment, and anti-discrimination laws, including any required salary or compensation-range disclosures (such as New York pay-transparency requirements where applicable). We do not review job Listings for such compliance.

7. Moderation, Removal, and Reporting

We may, but are not obligated to, moderate Listings before or after publication. We may remove or refuse any Listing, suspend or terminate any account, and take any other action we deem appropriate, at our sole discretion, with or without notice, for any reason, including suspected violation of these Terms or applicable law. Our right to moderate does not create any obligation to monitor, and does not make us responsible or liable for User Content (see Section 8).

Reporting abuse. To report a scam, suspicious Listing, illegal content, fraud, impersonation, discrimination, housing violation, job scam, or safety concern, contact [email protected] with the Listing URL and relevant details.

Record preservation. We may preserve records related to reported abuse, fraud, scams, payment disputes, prohibited Listings, or legal requests for as long as reasonably necessary to investigate, enforce these Terms, protect Users, cooperate with law enforcement, or defend legal claims.

8. Platform Immunity — User-Generated Content

Drobnica is an interactive computer service that hosts Content provided by third-party Users. In accordance with Section 230 of the Communications Decency Act (47 U.S.C. § 230), Polish Pages, Inc. is not the publisher or speaker of User Content and is not responsible or liable for any Listing or Content created, posted, or transmitted by Users. Any opinions, representations, or statements in Listings are those of the User who posted them. Our exercise of editorial or moderation functions — including the decision to publish, decline, edit, or remove Content — does not make us the publisher of any User Content and does not waive the protections of Section 230 or any other applicable law.

Nothing in this Section limits obligations or liability that cannot be limited under applicable law, including federal criminal law, intellectual property law, electronic communications privacy law, or sex-trafficking-related laws.

9. Copyright Policy (DMCA)

We respect intellectual property rights and respond to notices under the DMCA (17 U.S.C. § 512). We terminate the accounts of repeat infringers where appropriate. Your notice must include: (a) a physical or electronic signature of the copyright owner or authorized person; (b) the name, address, telephone number, and email of the copyright owner or agent; (c) identification of the copyrighted work; (d) identification of the infringing material and its location (URL); (e) a good-faith-belief statement; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We may forward your notice to the User who posted the material.

Counter-Notice. If you believe your Content was removed in error, you may submit a counter-notice with the information required by Section 512(g)(3). We will forward it to the original complainant. If they do not file a court action within fourteen (14) business days, we may, at our discretion, restore the Content.

10. Trademarks

Trademarks not owned by Polish Pages that appear in Listings are the property of their respective owners. We do not claim ownership of third-party trademarks and use them, if at all, only in a descriptive, nominative, or other lawful manner.

11. Paid Features (Featured and Promoted Listings)

Posting a standard Listing is free. We offer optional paid features such as Featured Listings, promotion, or extended visibility (“Paid Features”).

Payment Processing. Processed by Stripe, Inc. We do not store full payment card numbers. Your use is also subject to Stripe’s terms and privacy policy.
Pricing. Displayed at the point of purchase. We may change prices anytime; changes apply only to future purchases.
Non-Refundable. Fees for Paid Features are non-refundable once the Featured/Promoted Listing has gone live, except where required by law. If we remove a Listing for violation of these Terms, no refund is due.
No Guarantee of Results. Paid Features increase visibility but do not guarantee any specific number of views, responses, inquiries, sales, or outcomes.
Payment problems, fraud, and chargebacks. We may refuse, reverse, cancel, or remove a Paid Feature if payment is declined, reversed, charged back, suspected of fraud, or associated with a prohibited Listing. Chargebacks do not limit our rights to recover unpaid amounts, fees, or costs where permitted by law.
Taxes. You are responsible for any taxes associated with your purchase, except taxes on our net income.

12. Privacy

Our Privacy Policy explains how we collect, use, and protect personal data. By using the Service, you acknowledge the collection and use of information in accordance with the Privacy Policy.

13. Automated Tools and AI

We may use automated tools, spam filters, fraud detection, or AI-assisted moderation and content workflows to operate and secure the Service. We do not rely on automated tools to make legally significant decisions about Users without appropriate human review where required by law. AI-assisted outputs may be reviewed, edited, rejected, or removed by Company personnel.

14. Disclaimer of Warranties

The Service and all Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any Listing or Content is accurate, reliable, legal, or safe. We make no warranty regarding any goods, services, or transactions advertised on or obtained through the Service. To the maximum extent permitted by law, we disclaim all warranties.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Polish Pages, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service, any Listing, or any transaction or interaction with another User.

Aggregate liability cap. To the maximum extent permitted by applicable law, our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the total amount you paid us, if any, for Paid Features in the six (6) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Because Drobnica is a free or low-cost classifieds venue and not a party to User transactions, this allocation of risk is a fundamental basis of the agreement. Liability for intentional misconduct, unpaid fees, or IP misuse is excluded from this cap where the law permits.

16. Indemnification

You agree to defend, indemnify, and hold harmless Polish Pages, Inc., its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your Listings or other Content; (b) your use of the Service; (c) your transaction, communication, dispute, employment arrangement, lease, sale, purchase, or other interaction with another User; (d) your violation of these Terms; (e) your violation of any law or regulation; or (f) your infringement or misappropriation of any third-party rights.

17. Dispute Resolution — Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

You and Polish Pages agree to resolve any Dispute exclusively through final and binding individual arbitration, except as set out below.

Consumer Due Process. For consumer disputes, this arbitration clause complies with the applicable provider’s consumer due process standards, fee schedules, notice requirements, and small-claims carve-outs.

Small-Claims and Consumer Carve-Out. If you are a consumer (using the Service for personal, family, or household purposes), you may bring an individual claim in your local small-claims court instead of arbitration, if it qualifies.

Administration. AAA (www.adr.org) or JAMS (www.jamsadr.com) before a single arbitrator, under applicable consumer or expedited rules. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs.

Venue. Consumers bringing personal/household/family claims: hearing in the county where you reside. Otherwise: New York City, NY, or another mutually agreeable location.

Class / Representative Action Waiver. You and Polish Pages agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Class arbitrations and class actions are not permitted. You waive any right to a jury trial.

If the class/representative waiver is found unenforceable, this entire Section 17 shall be void. Otherwise, any unenforceable portion is severed and the remainder enforced.

Governing Law. Laws of the State of New York, excluding conflict-of-laws rules. Subject to the arbitration provision, the state and federal courts in New York, New York have exclusive jurisdiction over matters not subject to arbitration.

18. Termination

We may suspend or terminate your access, remove your Listings, or close your account at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including 3, 5.2, 7, 8, 9, 14, 15, 16, 17, and 19) will survive.

19. General Provisions

Changes to These Terms. We may modify these Terms by posting the revised version and updating the “Last Updated” date. For material changes, we will provide reasonable notice. Continued use after changes take effect constitutes acceptance.
Force Majeure. Not liable for delays/failures from causes beyond our reasonable control.
Assignment. You may not assign without our prior written consent; we may assign at our discretion.
Severability. Unenforceable provisions are severed; the rest remains in force.
No Waiver. Failure to enforce is not a waiver.
Entire Agreement. These Terms, with the Privacy Policy and any feature-specific terms, constitute the entire agreement regarding the Service.
